Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HouseCall mobile application ("App") and the on-demand home physician visit services ("Services") provided through it. Please read these Terms carefully before using HouseCall. By creating an account or using the App, you agree to be bound by these Terms.

Emergency Services — Read First

🚨 HouseCall is NOT an emergency service. If you or someone near you is experiencing a life-threatening emergency — including chest pain, difficulty breathing, loss of consciousness, stroke symptoms, severe bleeding, or any other immediately life-threatening condition — call 911 (or your local emergency number) immediately or go to the nearest emergency room. Do not use this app to request care for emergencies. HouseCall physician response times are not suitable for life-threatening situations.

HouseCall is designed for non-emergency medical visits. By using this App, you acknowledge and accept that it is not a substitute for emergency medical services.

Eligibility & Account Registration

3.1 Eligibility

To use HouseCall, you must:

Parents or legal guardians may request visits on behalf of minors under their care. By doing so, they accept full responsibility under these Terms for the minor's use of the Services.

You must create an account to use HouseCall. You agree to:

HouseCall reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

Nature of the HouseCall Service

4.1 Technology Platform — Not a Medical Provider

Important: HouseCall is a technology marketplace that connects patients with independent licensed physicians. HouseCall itself does not provide medical services, employ physicians, or practice medicine. All medical services are provided by independent contractor physicians who use the HouseCall platform to find and serve patients.

HouseCall does not control the clinical judgment, diagnoses, treatment plans, or prescriptions made by physicians. Physicians are solely responsible for the medical services they provide.

4.2 Independent Contractor Physicians

All physicians on the HouseCall platform are:

HouseCall is not liable for any act, omission, negligence, or malpractice by any physician using the platform.

4.3 Service Availability

HouseCall operates in specific geographic areas. Service availability depends on the number of physicians online in your area at the time of your request. HouseCall does not guarantee that a physician will be available at any given time. Visit matching is not guaranteed.

Visit Process & Patient Responsibilities

5.1 Requesting a Visit

When you submit a visit request, you agree to:

You are responsible for providing accurate and complete medical history, including current medications, allergies, and relevant conditions. Providing false or incomplete medical information may endanger your health and may result in termination of your account.

5.3 Prescription Policy

Prescriptions may only be issued by physicians at their sole clinical discretion. HouseCall does not guarantee that any prescription will be issued following a visit. Prescriptions issued through the platform are for legitimate medical use only. HouseCall reserves the right to investigate and report suspected prescription fraud to appropriate authorities.

5.4 AI Health Assistant (Mira)

The app includes "Mira," an AI-powered health information assistant. Mira is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking care based on Mira's responses. Always consult a qualified physician for medical decisions.

Payments, Pricing & Refunds

6.1 Pricing

Visit fees are displayed in the App before you confirm a visit request. Prices are denominated in Mexican Pesos (MXN) or United States Dollars (USD) as indicated in the App. Prices are subject to demand-based surge pricing, which will be clearly disclosed before you confirm. The price shown at the time of doctor acceptance is the price you will be charged — it does not change after a doctor accepts your request.

6.2 Payment Processing

All payments are processed by Stripe, Inc., a third-party payment processor. By adding a payment method, you agree to Stripe's Terms of Service. HouseCall does not store full credit or debit card details. A platform service fee (currently 5% of the visit fee) is included in the displayed price.

6.3 Cancellation & Refund Policy

Patient-Initiated Cancellation: Free cancellation is available before a physician accepts your request. After acceptance, a partial refund may apply based on how much time has passed.
Physician-Initiated Cancellation: If a physician cancels after accepting your request, you will receive a full refund to your original payment method.

Refund processing time depends on your card issuer and is typically 5–10 business days.

6.4 Disputed Charges

If you believe you have been charged incorrectly, contact us at billing.housecall@aviantacapital.com within 30 days of the charge. We will investigate and respond within 10 business days.

Physician Accounts

If you register as a physician on HouseCall, in addition to the above Terms, you agree to:

HouseCall reserves the right to suspend or permanently remove any physician whose credentials cannot be verified, who receives sustained poor ratings, or who violates these Terms or applicable professional standards.

Prohibited Conduct

You agree not to:

Violation of any of the above may result in immediate account suspension, permanent ban, and/or referral to appropriate legal authorities.

Ratings & Reviews

After a completed visit, patients may rate their physician and leave a review. By submitting a rating or review, you:

HouseCall reserves the right to remove reviews that violate these Terms or appear to be fraudulent.

Intellectual Property

The HouseCall application, including its design, source code, brand name, logo, and all original content, is the exclusive intellectual property of Patricio Rivero and is protected under applicable Mexican and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any part of the App without prior written permission.

All medical content generated during visits (prescriptions, clinical notes, visit summaries) belongs to the patient and the treating physician respectively, and HouseCall claims no ownership over such content.

Disclaimers & Limitation of Liability

11.1 No Medical Warranty

⚠️ HouseCall provides a technology marketplace only. HouseCall makes no warranties, express or implied, regarding the quality, accuracy, completeness, or suitability of any medical services provided by physicians through the platform. All medical services are provided by independent physicians at their own professional discretion.

11.2 Service Availability Disclaimer

HouseCall is provided on an "as is" and "as available" basis. We do not warrant that the App will be available at all times, error-free, or free from viruses or other harmful components. We reserve the right to suspend, modify, or discontinue the Service at any time without notice.

11.3 Limitation of Liability

To the maximum extent permitted by applicable Mexican law, HouseCall, its operators, officers, and employees shall not be liable for:

In any event, HouseCall's total aggregate liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the total amount you paid to HouseCall in the 30 days preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless HouseCall, Patricio Rivero, and their respective officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States, without regard to its conflict of law provisions. Applicable laws include but are not limited to:

13.2 Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or your use of HouseCall, both parties agree to first attempt to resolve the dispute informally by contacting legal.housecall@aviantacapital.com. We will endeavor to resolve complaints within 30 days of receipt.

If informal resolution fails, the parties agree to submit to the exclusive jurisdiction of the competent courts of Monterrey, Nuevo León, Mexico. Both parties waive any objection to the jurisdiction of such courts.

13.3 Consumer Rights

Nothing in these Terms limits your rights as a consumer under the LFPC or any other applicable consumer protection law. You may also file a complaint with Mexico's consumer protection agency, PROFECO (www.gob.mx/profeco).

Changes to These Terms

HouseCall reserves the right to update these Terms at any time. When we make material changes, we will:

If you do not agree to updated Terms, you must stop using the App and request account deletion. Continued use after the effective date of updated Terms constitutes acceptance.

15

General Provisions

15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

15.2 Entire Agreement

These Terms, together with our Privacy Policy (Aviso de Privacidad) and any additional policies referenced herein, constitute the entire agreement between you and HouseCall regarding your use of the App and supersede all prior agreements.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of HouseCall.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. HouseCall may assign these Terms in connection with a merger, acquisition, or sale of assets without restriction.

15.5 Apple Platform Disclaimer

HouseCall is distributed through the Apple App Store. Apple Inc. is not a party to these Terms and has no obligation to provide support or maintenance for the App. In the event of any conflict between these Terms and Apple's App Store terms, Apple's terms will govern solely with respect to the distribution and operation of the App on Apple devices.
